Introduction

This privacy policy explains how Lisa Sharpe Art collects and uses your personal data when you visit www.lisasharpeart.com, buy an artwork or print, commission a painting, sign up to my newsletter, contact me or take part in a prize draw.

By providing your data, you confirm that you are over 13 years of age.

Who I am

Lisa Sharpe Art is the data controller and is responsible for your personal data (referred to as "I", "me" or "my" in this policy).

  • Name: Lisa Sharpe Art
  • Email: art@lisasharpeart.com
  • Location: Stockbridge, Hampshire SO20 6LN, UK (full postal address on request)

If you're not happy with how I collect or use your data, you have the right to complain to the Information Commissioner's Office (ICO), the UK supervisory authority for data protection (ico.org.uk). I'd be grateful if you would contact me first, so I can try to resolve it for you.

Please let me know if your personal information changes by emailing art@lisasharpeart.com.

What data I collect

Personal data means any information that can identify you. I may collect:

  • Identity data: your name and title.
  • Contact data: your email address, phone number, billing and delivery addresses.
  • Transaction data: details of your purchases and payments. Card payments are processed securely by Shopify and PayPal: I never see or store your full card details.
  • Technical data: your IP address, browser type, device, time zone and location setting, collected automatically when you visit my website.
  • Usage data: how you use my website, such as the pages you visit.
  • Marketing data: your preferences for receiving emails from me.
  • Commission data: the colours, feelings and intentions you share with me when commissioning a painting, used only to create your artwork.

I don't collect any special category data (such as information about health, religion or ethnicity), or information about criminal convictions.

If you don't provide the data I need to fulfil an order or commission, I may not be able to complete it, but I will always let you know.

How I collect your data

  • Directly from you: when you place an order, commission a painting, sign up to my newsletter, enter a prize draw, or contact me by email, phone or my website.
  • Automatically: when you browse my website, through cookies and similar technologies (see Cookies below).
  • From third parties: such as analytics information from Google.

How I use your data

Under UK data protection law (UK GDPR), I only use your data where I have a lawful reason to do so:

  • To fulfil your order or commission (contract): processing payments, creating your artwork, delivery and keeping in touch about your order.
  • For my legitimate interests: running and improving my website and business, and keeping it secure.
  • To meet legal obligations: such as keeping tax records.
  • With your consent: sending you my newsletter and marketing emails.

Marketing emails

You'll only receive marketing emails from me if you've signed up to my newsletter, or if you've bought from me and haven't opted out. You can unsubscribe at any time using the link at the bottom of every email, or by emailing art@lisasharpeart.com.

I will never sell your data, and I won't share it with anyone for their own marketing purposes.

Who I share your data with

I only share your data with trusted service providers who help me run my business, and only for the purposes described in this policy:

  • Shopify: my website and online shop
  • Shopify Payments and PayPal: secure payment processing
  • Klaviyo: my newsletter and emails
  • Google: website analytics
  • My print studio and delivery companies: to make and send your order
  • Professional advisers, such as my accountant, and HM Revenue & Customs where required by law

All of them are required to keep your data secure and to use it only on my instructions.

International transfers

Some of my service providers, such as Shopify, Klaviyo and Google, are based outside the UK, including in the United States, so your data may be transferred there.

When this happens, I make sure your data is protected by at least one of the following safeguards:

  • the country is recognised by the UK as providing adequate protection for personal data
  • the provider is certified under the UK Extension to the EU-US Data Privacy Framework
  • the provider uses legally approved contracts that give your data the same protection it has in the UK

Please email art@lisasharpeart.com if you'd like more details.

Keeping your data secure

I have appropriate security measures in place to prevent your personal data from being lost, misused or accessed without permission. If a data breach ever occurred, I would notify you and the ICO where legally required.

How long I keep your data

I only keep your data for as long as I need it. By law, I keep basic customer records (contact, identity and transaction details) for six years for tax purposes. If you unsubscribe from my emails, I keep your email address only to make sure you aren't contacted again.

Your rights

Under UK data protection law, you have the right to:

  • access the personal data I hold about you
  • ask me to correct it
  • ask me to delete it
  • object to, or ask me to restrict, how I use it
  • ask me to transfer it to you or another organisation
  • withdraw your consent at any time

To use any of these rights, simply email art@lisasharpeart.com. There's no fee, and I'll respond within one month.

Cookies

Cookies are small files saved on your device when you visit a website. My website uses cookies to make it work properly (for example, remembering what's in your basket), to understand how visitors use it through Google Analytics, and to show my newsletter sign-up form at the right time through Klaviyo.

You can choose which cookies to accept using the cookie banner on my website, or by changing your browser settings. If you turn off all cookies, some parts of the website may not work properly.

My website may link to other websites, such as Instagram. I'm not responsible for how they handle your data, so please read their own privacy policies.

Changes to this policy

I may update this policy from time to time, and the latest version will always be on this page.
